1. Definitions


1.1 "Customer" means the person who accepts a quotation off the Company for the sale of Goods or whose order for the Goods is accepted by the Company

1.2 "Company" means UK Cooler Market Place ltd registered in England.

1.3 The headings in these Conditions are for convenience only and shall not affect their interpretation.


2.             Basis of Sale

2.1 The following terms and conditions apply to all transactions received by the Company via the telephone, Internet, mail and email. The placement of an order through these methods indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference. Terms and conditions do not affect your statutory rights.

2.2 No variation to these Conditions shall be binding unless agreed in writing between authorised representatives of the Customer and the Company.

2.3 The Customer shall ensure that the capacity and performance of any goods purchased are suitable for the Customers purpose.

2.4 Any typographical, clerical or other error or omission in any sales literature, brochure, quotation, price list, acceptance of offer, invoice or other document or information issued by the Company shall be subject to correction without any liability on their part.


3. Product & Pricing General Information


3.1 All product specifications, images and other information published in our advertisements and on our website have been made accessible by suppliers, manufacturers and publications. The Company cannot guarantee the reliability or accuracy of the information and prices described, published or quoted, please note that these terms and conditions do not affect your statutory rights

3.2 All products sold are of a technical nature and we are sometimes unable to give full specifications. All images, descriptive matter, specifications in our advertisements, relayed by telephone and on the Internet are for the sole purpose of giving an approximate description. Full details of specifications are available from manufacturer’s brochures or their websites.

3.3       Please note that any Special Order Item will not be accepted for refund unless faulty, as the Item will be ordered especially for you and subsequently cannot be resold.

3.4 The company reserves the right, by giving notice to the customer at any time before delivery, to increase the price of the Goods to reflect any increase in the cost to the company which is due to any factor beyond the control of the company.

3.5 The price is exclusive of any applicable value added tax which the customer shall be additionally liable to pay the company.

3.6        All products and services are subject to availability and may be withdrawn at any time. If the goods are not supplied as specified within a reasonable period of time, we may offer a similar product or will refund you if the transaction is cancelled. We shall not be liable for any losses, costs, damages, charges, or any expenses caused by any delay in the delivery of the goods if they are delivered in a reasonable period of time.


4.             Errors and Omissions


4.1 In the event a product is listed or quoted at an incorrect price due to an error from our suppliers or publishers. We reserve the right to refuse any orders listed at the incorrect price. If your credit/debit card has been charged and we subsequently cancel your order, we will immediately issue a refund to your credit/debit card.


5.             Payment

5.1 Any Customer who does not hold an authorised credit account must pay for the goods at the time of ordering.

5.2 The Company accepts all major credit/debit cards including Visa, MasterCard, American€ Express and Switch. You must provide us with your exact billing address and telephone number, which is held with your credit/debit card company. Any incorrect information given will cause delays in your ordered being processed.

5.3    Your order will only be processed once an authorisation code has been received. Cheques and postal orders take a minimum of 10 days from receipt until payment has cleared then goods can be released for dispatch. ADA AMACO CATERING EQUIPMENT reserves the right to charge 2.5% for credit card transactions, with 3% for Amex. All prices are subject to VAT in accordance with the rate at time of order from 1st Jan 2011 this will be 20%


6. Credit Accounts

The company can offer a credit account on a strictly 30 days net invoice basis, subject to status and the normal financial checks and reference. The company reserves the right to cancel this account in the event of non use, after a period of 6 months or continual delays in payment going over the agreed terms.


6.4       Please note when placing your order by Credit Card we shall only deliver to the address the Credit Card is registered to.


6.5 We understand and will exercise our statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to agreed credit terms


7. Delivery & Notification of Claims


7.1 Delivery of all products, which are available in stock, will be completed as a door-to-door service in the UK mainland only. Important notice! On acceptance of your delivery, if you are unable to have the contents of the package checked then please sign the delivery note UNCHECKED! It is your responsibility to check for damages at the time of delivery, if the carrier refuses to wait please sign as damaged.

Deliveries do not include uploading or installation (unless specifically quoted and paid for). You are responsible for ensuring the products will fit through your doorways.

7.2       Products will be delivered between 9AM-6PM working days from clearance of payment. The company reserves the right to use an alternative courier service where necessary.

7.3      If an arranged and confirmed delivery date relating to a product as stated in Para 5.2 fails due to a breach of contract by the customer then a re-delivery charge may apply.

7.4 Areas in northern and north western Scotland may be subject to longer delays and extra cost of delivery please check when ordering.

7.5  We will Endeavour to deliver goods within the times stated but goods are subject to availability and sometimes delays are outside our control. We shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay in the delivery of the goods if they are delivered within a reasonable period of time.

7.6 The company does not take responsibility for any change in delivery dates or any delay caused by any instructions of the customer or failure of the customer to give the company adequate information or instructions.

7.7 Shortages, damages and incorrect goods should be reported to the company within 24 hours from receipt, any delay in doing so may prejudice your claim.


8. Force Majeure


8.1 The company shall not be liable for delay or failure in performing his obligations under the contract to the extent that such failure or delay is caused or contributed to by any act of God, war, civil commotion, riot, strike, lockout, trade dispute, breakdown, accident or any other happening or event whatsoever (whether or not of a kind similar to those before mentioned) beyond the control of the company.


9. Return of Goods


9.1 Any goods which are returned will only be accepted within 7 days of delivery to the Customer provided that the goods are returned unused, in perfect condition, and in the original packaging and with an authorised returns number issued by the company

9.2 The Customer must contact the Company for authorisation to return goods. Any goods returned to the Company without authorisation or which are not in the condition set out above will be rejected and returned to the Customer at their cost


10 Risk & Title

10.1 Notwithstanding delivery and the passing of risk in the goods, or any other provision of these Conditions, the title of these goods shall not pass to the Customer till the Company has received in cash or cleared funds payment in full of the price of the goods and all other goods agreed to be sold by the Company to the Customer for which payment is then due.

10.2 Risk or loss or damage to the goods shall pass to the Customer upon delivery.


11.       Warranty

11.1 All products supplied are covered by the terms and conditions of the manufacturers guarantee. Standard warranty is 12 months parts & labour unless otherwise stated in writing in the customer’s quotation.

11.2 Our guarantees cover all electrical and mechanical parts it does not cover cosmetics, or excessive wear and tear.


11.2 The Company shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, operator error, abnormal working conditions, failure to follow the Company's or manufacturer's instructions (whether oral or in writing), misuse or alteration or repair of the goods without the Company's approval.


11.3 The Company shall be under no liability if the goods are not serviced and maintained in accordance with manufacturer's and Health and Safety Executive recommendations.


12. Other

12.1 You will own the goods once we have received your payment in full.

12.2 You will receive an invoice on receipt of the goods and copies are available.

12.3  Failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions.

12.4 These terms and conditions are subject to change at any time without prior notice to you and do not affect your statutory rights

13. Wee Directive on the disposal of commercial refrigeration units


13.1 All goods purchased from UK Cooler market place Ltd are subject to disposal under the Wee directive and this means that the goods must be disposed of in an environmentally friendly way.

Should you wish to dispose of the item you have purchased, we are liable to dispose of the unit in an environmental way. Your original purchase price does not entitle you to free collection and disposal cost. We are happy to collect and dispose of your item for you. Please contact our sales department to receive a quotation for Collection and environmental disposal. The normal charge is around £80.00 per unit. We are not liable for collection of units not supplied by us, but can offer a similar service, please check with our office if we can help!
